DMV points are counts the California DMV adds to a driving record for traffic convictions and at-fault accidents. Enough points in a set period make the driver a presumed negligent operator.
Vehicle Code §12810.5(a) presumes a driver is a negligent operator at 4 or more points in 12 months, 6 or more in 24 months, or 8 or more in 36 months. The DMV gives a hearing on request and considers how much the person drives. Class A and B drivers have higher thresholds for points earned in a commercial vehicle. If the license is suspended, the DMV may require proof of financial responsibility, such as an SR-22, for three years after reinstatement. Section 12810 lists how many points each violation counts.
