Standard general liability policies include a liquor liability exclusion — a clause that specifically removes coverage for any claim arising from the service, sale, or furnishing of alcoholic beverages. The exclusion applies regardless of whether you call yourself a brewery, a wine bar, or a restaurant. If a taproom customer drinks at your facility and later injures someone, your GL policy will not respond to that lawsuit.
California Business and Professions Code §25602.1 creates civil liability for alcohol sellers under specific conditions, and settlements in dram shop cases routinely reach six figures.
