DUI Insurance Impact

A California DUI changes two separate things on an auto policy. The DMV can require an SR-22 before it reinstates the license, and Insurance Code section 1861.025 keeps the driver out of the Good Driver Discount after a conviction.

Section 1861.02(a) ranks the driving-safety record first, ahead of miles and years licensed. A driver who still qualifies gets a Good Driver Discount at least 20 percent below the rate that would otherwise apply. Section 1861.025(c) withholds that status after a conviction under Vehicle Code section 23152 or 23153 in the window that starts on the later of January 1, 1999 or ten years before the application. The code states no percentage increase for the conviction. Section 16431(b) requires a proof certificate on every registered vehicle before reinstatement of a section 13352 suspension. The DMV ignition-interlock page calls that certificate an SR-22. The administrative per se fact sheet says the proof is kept for three years, and section 16480 lets the DMV cancel it any time after three years from the date it was required.
