Mexico auto insurance is a separate liability policy written by an insurer licensed under Mexican law, bought for driving a car in Mexico. California law does not treat a California policy as a substitute for it: if a California auto policy says its coverage extends to Mexico, the policy must carry a printed warning to buy coverage from a Mexican insurer.
What the California warning says
Insurance Code §11580.6 applies to a liability policy for a motor vehicle that contains a provision extending coverage to accidents in Mexico. That policy must carry an added provision, on its face or as an endorsement, with a WARNING: unless you have auto insurance written by a Mexican insurance company, you may spend many hours or days in jail if you have an accident in Mexico. It adds that coverage should be secured from a company licensed under the laws of Mexico to avoid complications and other penalties, including possible impoundment of the automobile.
What the section does and does not tell you
The section is about the wording that must appear on a policy. It does not say that every California policy ignores Mexico, and it does not say what any one policy pays south of the border. Some policies have no Mexico provision, some limit it to a short distance or a short stay, and the wording varies. The only way to know is to read the territory section of your own policy or ask the agent in writing before the trip. We have not verified the Mexican legal requirements themselves from a Mexican government source, so this page does not describe them.
Before a trip
Ask three things: does my California policy extend to Mexico at all, what is the limit, and does it stop at the border for liability. Then buy the Mexico policy for the dates of the trip and keep the California policy active, because the registration and your coverage at home do not pause.
