Insurance Lapse and Registration Suspension

An insurance lapse can suspend a California vehicle's registration. Insurers report private-passenger liability policies to the DMV under Vehicle Code section 16058, and section 4000.38 tells the department to suspend the registration when that coverage is cancelled and no replacement arrives in time.

Section 16058 gives the insurer 30 days to report a new policy and 45 days to report a termination. Section 4000.38(b) requires notice first, not less than 45 days in a cancellation. The DMV suspensions page lists three triggers: no insurance data within 30 days of a registration card, a cancellation with no replacement within 45 days, and false proof. Reinstatement takes evidence of financial responsibility and a $14 fee. Either item alone leaves the suspension in place. A field office does not clear it. Section 4000.37 still asks for proof at renewal unless the electronic report is already on file.
